We take the protection of your personal data very seriously and follow the legally valid regulations regarding data protection. On this Website, personal data will be recorded and processed only to the extent necessary for the operation of this online offer. The following declaration provides you with an overview of how we guarantee this protection and what type of data we record and for what purpose.


Personal data


Personal data consist of details regarding the personal or factual circumstances of a certain or identifiable natural person. Information that cannot be connected directly or indirectly to your identity, such as the number of users of a page, is not personal data.
In the case of the MyBuildings portal these consist of data you have made available to us yourself, such as registration data, contact data, or data added in connection with the services used, such as bank data, as well as data of devices which have been allocated to the user account.
The personal data you have made available to us within the scope of this online offer will be used exclusively for this purpose. Your personal information will not be passed on to third parties unless you grant express permission or if we are obliged to do so based on a law or decision of a court or public authority. An exception to this are order processors, whom we carefully select and contractually obligate to observe our instructions and to strictly adhere to the required technical and organisational measures for data protection.


Legal basis for processing


Unless specified otherwise, processing in case of a procurement of consent is carried out on the basis of Art. 6 Par. 1 lit. a DS-GVO for the performance of a contract or answering enquiries on the basis of Art. 6 Par. 1 lit. b DS-GVO for compliance with legal obligation on the basis of Art. 6 Par. 1 lit. c DS-GVO for safeguarding our entitled interests on the basis of Art. 6 par. 1 lit. f DS-GVO


Utilization data on the service platform of myABB-LivingSpace


Events are registered during each utilization process, such as which user or which device has accessed the system when and for which period or which services wered used. These data will also be made available to you in the form of a history. The retention time for these types of events is three months. Apart from this, our use of these data occurs solely in anonymous form for statistical purposes.


Logging


When accessing our website, your browser automatically sends data to our web server for technical reasons. In the process, this data consists of the date and time of access, URL of the referring website, file called up, volume of the transmitted data, browser type and version, operating system, and IP address. This data is evaluated for statistical purposes and then deleted.


Cookies


Cookies are small text files stored on your computer and saved by your browser. Our Internet pages use cookies at several points. They are intended to make our offer more user-friendly, more efficient, and more secure. Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Cookies do not damage your computer and contain no viruses. You have the possibility to deactivate this function in your browser or to set it in such a way that you can determine whether a cookie should be accepted in individual cases or not. In this case, however, limitations in the operability of our website may result.

Unity:

What kind of user data does Unity collect and what does Unity use it for?
Unity collects data such as device type, county, device language, in-app behavior and IP address. This information helps developers and publishers tailor apps for users and their devices, such as providing user languages, and app preferences.

Does Unity collect what the GDPR refers to as "special categories" of personal information about players, such as political, religious, or sexual orientation?

No. Unity only collects gameplay and device information. Unity does not collect these special categories of personal information.

What happens if a user opts-out of data collection?
On a per-app basis, the user's data is deleted.

As a user, how can I see the information an app has about me through Unity?

For any app that has implemented the Unity Data Privacy Plug-in, you will find a link inside the App's data protection section that will lead you to a page where you can then select "I would like to see my data." This may take up to 24 hours to process.

Analytics:

Is Unity classified as a processor or a controller when processing data under the GDPR?
Unity is a controller of user data that we collect via Unity Analytics.

Why does Unity provide an opt-out option? Is this opt-out consent?
The opt-out option that players see in the Privacy dashboard is not related to consent, but rather the right players have to object to data collection. It gives them the ability to object to our targeting, as called for in the GDPR. Because we have legitimate interests as a legal basis for our data processing, we do not require consent. Most other ad platforms function only as an SDK, meaning that they gather data and profile users for the purpose of advertising. This kind of in-game advertising (without any additional purpose) requires opt-in consent as its legal basis. Since Unity's technology and ad platform comprise SDKs, plugins, and the Unity engine itself, our data collection and usage serve legitimate interests beyond just ads. Data such as crash reports, bug fixes, and user-user communication, etc., are of legitimate interest to our gamers and developers.

What do I need to know about HW Stats in regards to the GDPR?
HW Stats collects certain identifiers that are unique to the device but are not used to track or profile users. The unique identifiers are pseudonymized and aggregated for statistical purposes (not related to "profiling" users). Unity processes this data on the basis of our legitimate interest.

What data does Unity Analytics collect?
Unity Analytics collects gameplay and device information from players who use apps made with Unity. The only Personally Identifiable Information (PII) collected is device ID and IP address. The other data collected includes hardware specs, usage data, in-app purchase behavior, and custom event data (if applicable).

What user data is collected by Developer Services?
Through reporting features - Performance Reporting, Bug Reporting (Alpha) - Developer Services collects error reports generated by an application made with Unity and information about the device it was collected on. Device information includes data that could be considered personal data (machine ID), but this information is anonymized before it is retained.

Where can I Opt-out of data-collection?
For any app that has implemented the Unity Data Privacy Plug-in, you can find the link to opt out of data collection from inside the App in the Data protection section.

In order to provide you with optimum information, our pages contain links that refer to the pages of third parties. Since these pages are the websites of other providers, we have no influence on the content, for which the respective provider is solely responsible. This data protection declaration thus does not apply to the linked pages of third parties.


Your rights


You have the right at any time to obtain information regarding the data stored about you, its origin, and the purpose of its storage. Our data protection officer will provide you with information regarding the saved data. To obtain information you must identify yourself as the person in question (about whom the information should be provided) or prove that you are authorised to receive information about a third person.

With the existence of the legal requirements you also have the right to:

  • Correction or deletion of you personal data
  • Limitation of processing
  • Objection to processing
  • Data transfer


If in your view our processing of your personal data violates applicable data protection law, you have the right of complaining to a relevant regulatory authority.


Duration of storage and deletion.


Your personal data will be deleted in accordance with the data protection law as soon as the purposes for the above-stated storage become inapplicable. However, a storage beyond the achievement of purpose can take place when we are obligated to do so on the basis of legal regulations. In this case, processing will be limited and the data will be deleted after the respective legal obligations have been abolished or been met.
